Can you own a business with your ex?

There’s certainly no legal provision against starting a business with your ex, although most people would never do so. However, married couples often start businesses together. If they then get divorced, they could find themselves in a position where they’re trying to decide what to do with the business.

The two main options involve selling either all or a portion of that company. For instance, you and your spouse could both sell and split up the money, dividing your interest in the business so that you can choose a new career path. Or, if one of you wants to continue working at the business and running it, you could buy the other person’s share.

Working together after the divorce

Still, you do have the option to keep working together as business partners. In some senses, this makes property division easier. You don’t have to sell the company. You don’t have to divide anything. You are both joint owners already, so you can keep working together and the property division requirement is already satisfied.

This can make your relationship complicated unless you’re on very good terms, of course. As such, you may want to take legal steps to protect your interests and even redefine your relationship. For example, after you get divorced, you may want to sit down and draft a partnership agreement. This way, you know exactly what you own and what rights you have.
